Janssen Inc. et al v Apotex Inc.
We successfully represented Janssen and BTG in this PMNOC application, the last of such proceedings to be heard under the “old” application procedures.
Justice Phelan agreed that Apotex’s allegations of non-infringement and invalidity were not justified and issued an order prohibiting the Minister of Health from issuing a notice of compliance to Apotex until after the patent expires.
