Janssen v. Dr. Reddy
We successfully represented Janssen in this motion brought by Dr. Reddy’s in the context of a PMNOC section 8 damages action.
Dr. Reddy’s was seeking to have a question of law determined before trial. The question of law related to whether Janssen could adduce evidence and argument at trial as to the ability of other generic competitors to enter the market in the Dr. Reddy’s but-for section 8 world. The Court agreed with our position that the question of law should be determined after a full trial, in the context of all relevant facts.
