Bayer Inc. v. Apotex Inc. and Cobalt Pharmaceuticals Company
We successfully represented Bayer in this patent infringement action.
Following a six week trial, the Federal Court agreed that Bayer’s patent covering YAZ and Yasmin birth control products was valid, rejecting all of Apotex’s numerous validity attacks, and was also infringed by the Apotex and Cobalt products.
We obtained an Order permanently enjoining Apotex and Cobalt from selling their generic products until patent expiry.
